Terms of Service

These Terms of Service ("Terms") govern your access to and use of Cedar Mist Resources (the "Service"), operated by Cedar Mist Labs, a sole proprietorship of Leslie Fletcher based in British Columbia, Canada ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who may use the Service

You must be at least 18 years old and able to form a binding contract to create an account or use the Service. The Service is intended for adults — parents, guardians, and educators — who create printable learning resources.

2. Intended use and scope

The Service is provided for personal, family, and individual educational use. It is not designed or licensed for managing classroom rosters, maintaining official student or school records, or any use that would make us a "school official" or service provider under student records laws (such as FERPA in the United States). You agree not to use the Service to maintain records on behalf of a school or district. We do not enter into data processing agreements for school records as part of the standard Service.

3. Your account

You are responsible for the information you provide, for keeping your credentials secure, and for all activity under your account. Notify us at support@cedarmistresources.com of any unauthorized use. An account belongs to the person or household that created it; you may invite other users to your account, and you remain responsible for their use.

4. Content you provide ("Personas" and inputs)

The Service lets you create profiles ("Personas") and inputs such as word lists to tailor the resources you generate. These may include information about a child (for example a name or nickname, age, grade level, and interests).

• You represent that you are the parent or guardian of any child described in a Persona, or are otherwise authorized by their parent or guardian to provide that information.
• You are responsible for the content you enter, and you agree to provide only the minimum information needed (for example, a first name or nickname rather than a full legal name).
• You retain ownership of your inputs. You grant us a limited license to process them solely to operate and provide the Service to you (including generating resources, see Section 5).
• How we handle this information is described in our Privacy Policy.

5. AI-generated resources

Some features use third-party artificial intelligence (currently Anthropic's Claude API) to generate resources from your inputs. To do this, your inputs (such as word lists and Persona context) are sent to the AI provider to produce the requested output.

AI-generated content may contain errors, inaccuracies, or content unsuitable for a particular learner. You are responsible for reviewing any generated resource before using it. We make no guarantee that generated content is accurate, age-appropriate, or fit for any particular purpose.

You may use the resources you generate for your own personal, family, and educational purposes.

6. Subscriptions, billing, and the free tier

The Service offers a free tier and one or more paid subscription plans. Paid plans are billed through our payment processor, Stripe.

• Free tier. The free tier may include limits (for example on how many resources you can save) and may display our own promotional banners.
• Paid plans. Paid subscriptions renew automatically (monthly or annually, per the plan you choose) until cancelled. By subscribing you authorize recurring charges to your payment method through Stripe.
• Price changes. We may change prices or plan features. We will give reasonable notice, and changes apply to your next billing period.
• Taxes. Prices may be exclusive of applicable taxes, which will be added where required.

7. Cancellation and refunds

You may cancel at any time; your paid access continues through the end of the billing period you have already paid for, and it will not renew thereafter. Except where required by law, payments are non-refundable. See our Refund Policy for details.

8. Acceptable use

You agree not to: use the Service unlawfully or for any prohibited purpose; attempt to access accounts or data that are not yours; interfere with or overload the Service; scrape, resell, or redistribute the Service or large volumes of generated content commercially; circumvent usage limits or entitlements; or submit content that is unlawful, infringing, or that you are not authorized to provide.

9. Intellectual property

The Service, including its software, design, and content (other than your inputs and the resources you generate), is owned by Cedar Mist Labs and protected by law. These Terms do not grant you any right to our trademarks or branding.

10. Third-party services

The Service relies on third parties, including Stripe (payments) and Anthropic (AI generation). Your use of those features may also be subject to the third party's terms. We are not responsible for third-party services.

11. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that generated content will be accurate or suitable.

12. Limitation of liability

To the fullest extent permitted by law, Cedar Mist Labs and Leslie Fletcher will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) CAD $50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Cedar Mist Labs and Leslie Fletcher from claims arising out of your content, your use of the Service, or your breach of these Terms.

14. Suspension and termination

We may suspend or terminate your access if you breach these Terms or to protect the Service or other users. You may stop using the Service at any time and may delete your account. Sections that by their nature should survive termination (e.g. ownership, disclaimers, limitation of liability) will survive.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example by email or in the Service). Continued use after changes take effect means you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of British Columbia, Canada, without regard to conflict of law rules. You agree to the exclusive jurisdiction of the courts located in British Columbia, Canada for any dispute, except where applicable consumer-protection law gives you other rights.
